1. ACCEPTANCE OF TERMS

By accessing or using CrazyEmojiWall ("the Site"), you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions, then you may not access the Site.

2. THE AUCTION

CrazyEmojiWall is a novelty auction where participants may place bids on emoji characters displayed on the Site. Bids are placed in U.S. Dollars (USD). The highest bid for each emoji at the end of the auction period will be deemed the winning bid.

• All bids are final and non-refundable.
• Each bid must be at least $1.00 USD greater than the previous bid on the same emoji.
• You may bid on any number of emojis, but you are responsible for payment of all winning bids.

3. PAYMENT & CARD HOLDS

When you place a bid, we authorize a temporary hold on your credit or debit card to verify funds. No charges are processed at the time of bidding.

• Card holds may appear on your statement as "pending."
• If you are outbid, the hold is released automatically.
• If you win, the hold will be captured as a charge within 48 hours of auction close.
• We reserve the right to disqualify bids from cards that cannot be verified.

4. WINNING & OWNERSHIP

Winning bidders receive a digital certificate of ownership and their name/handle displayed on the emoji tile on the Site. This is a commemorative, novelty ownership claim — you do not receive any intellectual property rights, trademark, copyright, or exclusive commercial use of the emoji character itself. Unicode emoji characters remain in the public domain or are owned by their respective rights holders.

5. PROHIBITED CONDUCT

Users may not:

• Use automated bots, scripts, or any artificial means to place bids.
• Place bids with stolen or unauthorized payment methods.
• Harass other users or submit false or misleading information.
• Attempt to disrupt or interfere with the Site or auction.

6. DISCLAIMERS

THE SITE AND AUCTION ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR SECURE ACCESS TO THE SITE. IN NO EVENT SHALL CRAZYEMOJIWALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.

7. PRIVACY

We collect only the information necessary to process bids and display winning names (such as your chosen handle and Instagram handle, if provided). We do not sell your personal data to third parties. Payment information is handled securely by our payment processor and is never stored on our servers.

8. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes constitutes acceptance of the revised Terms.

9. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
